Accessing and/or using the website www.pharmacloud.ro implies the express and full acceptance of these Terms and Conditions. If you do not agree with any of these provisions, do not use the website and do not use the platform.

Article 1 – General Information

1.1 The platform and the website are operated by PHARMA CLOUD S.R.L., a limited liability company, registered with the Trade Register under no. J2025056391007, Tax ID (CUI) 52231652, with its registered office in Bucharest, Sector 2, Pantelimon St. no. 324, bl. D1, sc. A, fl. 8, ap. 41, hereinafter referred to as “Pharma Cloud”.

1.3. These Terms and Conditions apply to all users of the website, the educational platform, the applications, the subdomains and the related services, regardless of the means of access.

1.4. Accessing the platform, creating an account or using the platform constitutes the express, full and unconditional acceptance of these Terms and Conditions.

Article 2 – Nature of the Platform. Lack of CME Accreditation

2.1. Pharma Cloud is an educational platform that offers digital courses, educational games, clinical cases and support materials for the university learning process in the pharmaceutical and medical fields.

2.2. The content is exclusively didactic, informative and formative in nature.

2.3. The platform does NOT constitute accredited professional training courses, continuing medical education programs, or programs recognized by professional authorities or public institutions.

2.4. Pharma Cloud does NOT grant and CANNOT grant CME (Continuing Medical Education) credits and does not provide certificates with professional or legal value.

2.5. The user declares that they have taken note of these aspects and waives any claims related to professional recognition, accreditation or CME credits.

Article 3 – Account Creation and Use

3.1. Access to certain features requires the creation of a user account.

3.2. The user is solely responsible for the accuracy of the data provided, the confidentiality of their credentials, and all activities carried out through their account.

3.3. Pharma Cloud reserves the right to suspend or delete accounts in the event of a breach of these Terms, abusive use, and suspicions of fraud or unauthorized access.

3.4. The platform is intended for persons aged at least 16. Users under 18 declare that they use the platform with the consent of their legal representative.

Article 4 – Payments and Access to Content

4.1. Access to certain materials may be conditional upon the payment of fees displayed on the platform.

4.2. Payments are made through authorized third-party payment processors, in accordance with their terms.

4.3. Pharma Cloud does not store bank card data and is not liable for malfunctions of the payment processors.

Article 5 – Intellectual Property Rights

5.1. All content on the platform (texts, courses, games, design, graphics, logos) is the property of Pharma Cloud or its partners.

5.2. Copying, distributing, reselling or reproducing the content without written consent is strictly prohibited.

Article 6 – Right of Withdrawal. Digital Content

6.1. Pursuant to art. 16 lett. m of GEO no. 34/2014 on consumer rights, the supply of digital content that is not delivered on a tangible medium is exempt from the right of withdrawal once performance of the contract has begun, with the express consent of the consumer.

6.2. By purchasing a subscription or access to digital content and by ticking the dedicated box during the order process, the user:

a) expressly requests the immediate commencement of the supply of the digital content;

b) confirms that they are aware that they lose their right of withdrawal provided for by GEO no. 34/2014.

Article 7 – Reviews, Feedback and Marketing

7.1. By posting reviews, comments, feedback or by actively participating on the platform, the user grants Pharma Cloud the non-exclusive, free and unlimited right to use their name (or username), feedback and expressed opinions for the purposes of promotion, marketing and commercial communication, including on the website, the platform, social media or promotional materials.

Article 8 – Limitation of Liability

8.1. The content of the platform does not substitute for medical practice, specialist consultation, or professional decisions made by medical staff or pharmacists.

8.2. Pharma Cloud is not liable for the erroneous interpretation of the materials, professional decisions made on the basis of the content, or any damages resulting from the use of the information.

Article 9 – Data Security and Incidents

9.1. Pharma Cloud implements reasonable technical and organizational measures to protect data.

9.2. Pharma Cloud cannot be held liable for damages caused by cyberattacks, unauthorized access or security breaches that are not directly attributable to it.

9.3. Pharma Cloud is not responsible for the malfunction of the application caused by the operating system, app store updates or incompatibilities of the user’s device.

Article 10 – Applicable Law

10.1. This document is governed by Romanian law.

10.2. Disputes shall be settled by the competent courts in Romania.
